Terms of Service

1. Acceptance of Terms
By accessing and using CareMatchr (the "Platform"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and HR Metrix Solutions, the operator of CareMatchr. If you do not agree to these Terms, you may not use the Platform.
2. About the Platform
CareMatchr is an online marketplace that connects healthcare workers with organizations requiring qualified staff. The Platform facilitates shift postings, matching, scheduling, messaging, and payment processing. CareMatchr is not a healthcare provider and does not employ, supervise, or control workers, nor is it a party to any service agreements between users.
3. Account Registration
You must create an account to access the Platform's features. You agree to provide accurate and current information and to maintain only one active account. We reserve the right to refuse or terminate any registration at our discretion.
4. Account Security
You are responsible for safeguarding your account credentials and for all activities conducted under your account. You must notify us immediately of any unauthorized use. We are not liable for any loss resulting from unauthorized access.
5. User Roles
The Platform supports the following user roles: Workers (who claim shifts), Employers (who post shifts), and Administrators (who manage platform operations and compliance).
6. Shift Claiming and Compliance
Shift claims are subject to qualification verification. Workers may only claim shifts for which they hold valid and current certifications. The Platform uses safeguards to prevent double-booking and ensure compliance.
7. Certification Requirements
Workers are responsible for maintaining valid certifications and providing accurate records. False or misleading information may result in immediate account termination.
8. Code of Conduct
Users agree not to engage in unlawful, fraudulent, or abusive behavior, including misrepresentation, harassment, data scraping, or attempts to compromise platform security.
9. Payments
All payments are processed through the Platform. Employers agree to pay for completed shifts, and workers receive payments accordingly. The Platform does not guarantee payment in cases of disputes or incomplete work. Users are responsible for applicable taxes.
10. Background Checks
The Platform may provide guidance or third-party resources for background checks but does not guarantee or warrant their accuracy or completion.
11. Independent Contractor Status
Workers using the Platform are independent contractors and are not employees of CareMatchr or HR Metrix Solutions.
12. Intellectual Property
All content, software, and materials on the Platform are the property of HR Metrix Solutions or its licensors and may not be used without permission.
13. Limitation of Liability
To the fullest extent permitted by law, HR Metrix Solutions shall not be liable for indirect or consequential damages. Total liability shall not exceed the greater of fees paid in the previous six months or $500 CAD.
14. Indemnification
You agree to indemnify and hold harmless HR Metrix Solutions from any claims arising from your use of the Platform or violation of these Terms.
15. Account Termination
We may suspend or terminate accounts for violations of these Terms. Upon termination, access to the Platform ceases immediately.
16. Dispute Resolution
These Terms are governed by the laws of Manitoba, Canada. Any disputes shall be resolved in the courts of Manitoba.
17. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of any changes.
